Terms of Service

1. Service Description

Licensio (“the Service”) is an IP intelligence platform that scans Turkish retail catalogs (BIM, ŞOK) to detect products carrying licensed intellectual property. The Service is operated by Licensio and is provided “as is” for informational and business intelligence purposes.

2. Data Ownership

All scan results, detection data, and analysis reports generated by the Service are owned by Licensio. Users are granted a limited, non-exclusive, non-transferable license to access and use the data for their own internal business purposes only.

Catalog images and product information remain the property of their respective retailers. Licensio processes this data solely for IP detection analysis.

3. Intellectual Property Protection

The Service is designed to assist IP rights holders and legal professionals in identifying potential unlicensed use of intellectual property in retail contexts. Detection results are provided as indicative findings and do not constitute legal advice or a definitive determination of infringement.

Users must not use the Service to harass, threaten, or make unlawful claims against any retailer or manufacturer without independent legal verification.

4. Permitted Use

You may use the Service for:

  • Monitoring retail catalogs for potential IP licensing opportunities
  • Internal business intelligence and market research
  • Identifying unlicensed use of your own intellectual property
  • Generating reports for legal review by qualified professionals

You may not use the Service to:

  • Scrape, copy, or redistribute Service data to third parties
  • Attempt to reverse-engineer the detection algorithms
  • Access the Service using automated tools beyond authorized API usage
  • Violate any applicable law, including Turkish IP law (FSEK) and GDPR

5. Accuracy Disclaimer

Detection results are generated by AI models and may contain errors, false positives, or false negatives. Licensio makes no warranty regarding the accuracy, completeness, or fitness for purpose of any detection result. All findings should be independently verified before taking any legal or commercial action.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Licensio and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, including but not limited to loss of profits, data, or business opportunities.

Licensio's total liability for any claim arising out of or relating to these Terms or the Service shall not exceed the amounts paid by you for the Service in the twelve (12) months preceding the claim.

7. Privacy

We process only the data necessary to provide the Service. Catalog images are analyzed transiently and not stored beyond what is required for detection reporting. User account data is handled in accordance with our Privacy Policy and applicable data protection regulations including KVKK and GDPR.

8. Changes to Terms

Licensio reserves the right to update these Terms at any time. Continued use of the Service after any changes constitutes acceptance of the revised Terms. We will notify active users of material changes by email.

9. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Any disputes shall be resolved in the courts of İstanbul, Turkey, unless otherwise required by applicable consumer protection law.
